Terms of Service

These Terms govern your access to and use of the heroku.tech website. By using the site, you accept these Terms. Contracted use of Heroku data services is governed by the relevant service agreement, which controls over these Terms where they conflict.

1. The Site and the Services

The content on this site — articles, solutions descriptions, methodology notes and figures — is provided for general information about Heroku and our field. It is professional commentary, not advice, and should not be your sole basis for a business, investment or purchasing decision. Contracted services (data programs, APIs, deliverables) are defined and warranted exclusively in their service agreements.

2. Acceptable Use

You agree not to misuse the site: no attempts to breach security or access non-public systems, no automated load generation, no submission of unlawful or infringing content through forms, and no scraping or redistribution of site content without permission. The Acceptable Use Policy provides further detail and forms part of these Terms.

3. Intellectual Property

The site's design, copy, structure, marks and code are owned by Heroku or its licensors and are protected by intellectual-property laws. You may quote and link to published content with attribution; any other reproduction or commercial use requires our written permission. Comments you submit remain yours, but you grant us a license to display them on the page they were submitted to.

The site may reference third-party websites and sources. We do not control and are not responsible for their content, availability or practices; a reference is not an endorsement.

5. Disclaimers

The site is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error-free or secure, or that content will remain accurate or current.

6. Limitation of Liability

To the maximum extent permitted by law, Heroku will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from or relating to your use of the site. Heroku's total liability for claims relating to the site is limited to one hundred US dollars ($100).

7. Indemnification

You agree to indemnify and hold harmless Heroku and its personnel from claims, damages and expenses (including reasonable legal fees) arising from content you submit through the site or your violation of these Terms.

8. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, USA, excluding its conflict-of-laws rules. The state and federal courts located in San Francisco County, California have exclusive jurisdiction over disputes arising from these Terms, except where mandatory local consumer law provides otherwise.

9. Changes and Contact

We may revise these Terms at any time; the revision date above will change accordingly, and material changes will be reflected on this page. Questions about these Terms can be sent to legal@heroku.tech.
